These Terms of Service ("Terms") are an agreement between you and MAKENZO ("Makenzo Games," "we," "us," "our"). They cover the makenzogames.com website and set the baseline terms for every game we publish. Each game also has its own terms page with rules specific to that game. Where a game's terms are more specific than these, the game's terms apply to that game. Our Privacy Policy explains how we handle information and is part of these Terms.

The short version
- Our games are free to play. Some offer optional purchases and show non-personalized ads.
- Coins, cosmetics, and other in-game items are licensed, not sold. They have no real-world value and cannot be cashed out, traded, or transferred.
- Purchases are made through Apple or Google, and refunds follow their rules.
- If you are under 18, a parent or guardian must agree to these Terms for you.
- Be kind on leaderboards. We can remove names or restrict accounts that break the rules.
- We can change or retire a game, and these Terms may change over time.
Who can use our games and website
You may use our games and website only if you can form a binding agreement with us, or if your parent or legal guardian agrees to these Terms on your behalf. Our games are designed for a general audience that includes children. If you are under 18, please have a parent or guardian read and agree to these Terms for you. Parents and guardians who allow a child to play are responsible for the child's use of the game, including any purchases made through their Apple or Google account.
Your license to play
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and play our games on devices you own or control, for your own non-commercial entertainment, in line with these Terms and the rules of the app store you downloaded the game from. For games downloaded from the Apple App Store, that license also covers other devices associated with your Apple account through Family Sharing where the store allows it. We keep all rights not expressly granted here.
You may not:
- copy, modify, translate, reverse engineer, or create derivative works of a game, except where the law expressly permits it;
- sell, rent, lease, sublicense, or otherwise transfer a game or your access to it;
- cheat, use bots, scripts, exploits, or unauthorized third-party software, or interfere with a game's servers, leaderboards, or other players;
- use a game for any unlawful purpose or in a way that harms us, other players, or third parties.
Accounts and progress
Our games can be played as an anonymous guest. Some games let you optionally set a display name or link a social sign-in account to save and restore progress. You are responsible for activity under your account and for keeping any linked account secure. We may need to reset progress in rare cases, for example after a data error or a security incident, and we will try to avoid doing so.
Purchases, coins, and in-game items
Some games offer optional purchases, such as removing ads, and in-game currencies or cosmetic items that are earned by playing or bought with real money. All purchases are processed by the Apple App Store or Google Play under their terms; we never receive your payment details.
- Virtual items are licensed, not sold. Coins, cosmetics, and other in-game items are a limited license to use a feature inside the game. They have no monetary value, cannot be exchanged for money, and cannot be sold, traded, gifted, or transferred outside the game.
- We may change them. We may add, remove, rebalance, or discontinue virtual items and currencies, and their prices, at any time. If we retire a game, virtual items end with it.
- Refunds are handled by Apple or Google under their refund policies, because they process the payment. If you need help with a purchase that is not working, contact us and we will do what we can.
- Parental gate. Our games show a "grown-up check" before real-money purchases. Parents can also use the purchase controls built into iOS and Android.
Ads
Our free games may show ads, including optional rewarded ads that give an in-game bonus for watching. Ads in our games are non-personalized (contextual). Purchasing "Remove Ads," where offered, removes interstitial ads but does not remove optional rewarded ads you choose to watch. Ad availability is not guaranteed.
Display names, leaderboards, and conduct
Where a game offers public leaderboards, you may choose a display name that is shown to other players next to your score. Names are screened automatically, and we may change or remove any name that is offensive, impersonates someone, includes personal information, or otherwise breaks these Terms. Do not use scores or names to harass, mislead, or promote anything. We may remove scores that we believe were obtained by cheating.
Our content
Our games, website, artwork, characters, names, logos, music, and code belong to MAKENZO or our licensors and are protected by copyright and trademark law. You may share screenshots and videos of our games for personal, non-commercial purposes, including on social media and streaming platforms, as long as you do not claim the game as your own or use our content to promote anything unrelated to the game.
Changes to our games and Terms
We may update, change, suspend, or discontinue any game or feature at any time, including online features such as leaderboards and cloud save. We may also update these Terms. We will revise the "Last updated" date above and, for material changes, provide notice within the game or on this page. Continuing to use a game after a change means you accept the updated Terms. If you do not agree, stop using the game and delete it.
Ending your access
You can stop using our games at any time by deleting them. We may suspend or end your access to a game or its online features if you break these Terms, cheat, or abuse other players. If we do, you lose access to any virtual items and progress associated with the game, and we do not owe you a refund for them.
Third-party services and terms
Our games use third-party services, including Apple, Google, Unity Gaming Services, and ad networks, and you agree to follow any third-party terms that apply when you use the game. Our Privacy Policy lists the providers we work with.
Disclaimers
Our games and website are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that a game will be uninterrupted, error-free, or available on every device. Some jurisdictions do not allow these disclaimers, so parts of this section may not apply to you.
Limitation of liability
To the fullest extent permitted by law, MAKENZO will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data or progress, arising from your use of our games or website. Our total liability for any claim relating to a game will not exceed the amount you paid us for that game in the twelve months before the claim, or ten U.S. dollars if you paid nothing. Nothing in these Terms limits liability that cannot be limited by law.
Apple App Store terms
If you downloaded a game from the Apple App Store, the following also applies. These Terms are between you and MAKENZO only, not Apple, and MAKENZO is solely responsible for the game and its content. Apple has no obligation to provide maintenance or support for the game. If the game fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any, to you; to the fullest extent permitted by law, Apple has no other warranty obligation. MAKENZO, not Apple, is responsible for addressing any claims relating to the game, including product liability claims, claims that the game fails to conform to legal or regulatory requirements, and consumer protection claims, and for the investigation, defense, settlement, and discharge of any claim that the game infringes a third party's intellectual property rights. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Google Play terms
If you downloaded a game from Google Play, your use of the game is also subject to the Google Play Terms of Service, and purchases are subject to Google Play's payment and refund policies.
Governing law and disputes
These Terms are governed by the laws of the United States and the state in which MAKENZO is organized, without regard to conflict-of-law rules. If you have a problem, please contact us first; most issues can be resolved informally. Nothing in these Terms takes away rights you have under the consumer-protection laws of the country where you live.
